California Bill Would Require Employees in Outdoor Industries to Be Certified in Heat Illness Prevention
- Legislative Introduction: On February 8, 2024, Assembly Member Joaquin Arambula introduced Assembly Bill (AB) No. 2264, proposing legislation to mandate heat illness prevention certification for employees.
- Certification Requirement: AB 2264 aims to require employees in industries subject to California’s outdoor heat illness prevention regulation to obtain certification from Cal/OSHA within thirty days of hire, maintaining the certification throughout their employment.
- Compensable Hours and Expenses: The bill proposes that employers consider the time spent by employees on the certification process as compensable “hours worked.” Additionally, employers are obligated to cover the expenses associated with obtaining the heat illness prevention certification.
- Provisions for Employers: AB 2264 outlines employer responsibilities, including incorporating the certification process into on-the-job training, allowing participation during working hours, maintaining records, and relieving employees of other duties during the certification process. The legislation aims to be effective from July 1, 2028, if enacted.
